The decisions have reportedly already been taken, and a proposal is expected to go before the Cabinet on Thursday for approval and the formal appointment of the investigators. One of the investigators is expected to take on the role of lead investigator. Involvement of police officers to assist their work has not been ruled out. The names to be appointed may include surprises, potentially involving individuals from outside Cyprus, possibly from Greece or Britain, though this remains unconfirmed. The Presidential Palace has not disclosed any details, with announcements expected on Thursday. Why existing testimony cannot simply be reused The work facing the criminal investigators is expected to be considerably difficult, since identifying elements that raise suspicion of criminal offences is a different matter from identifying evidence that proves offences were committed and links them to specific individuals. The testimony gathered by the four inspectors appointed by the Independent Anti-Corruption Authority, meaning the statements taken from all individuals involved, cannot be used by the criminal investigators as evidence. As explained to Phileleftheros, statements from both the individuals implicated in the Mafia State allegations and others collected during the Authority’s investigation may be handed to the criminal investigators, but only for their information. The investigators must now take fresh statements from everyone on the basis of the criminal investigation, given the possibility the case could reach the courts. Legal and judicial expertise required This is why those appointed need investigative expertise, experience in criminal investigations and familiarity with the Cypriot judicial system, which is also why involvement of British specialists has not been ruled out. According to prominent lawyers, the issue is not only who is appointed, but the quality of the investigation, and above all whether the findings recorded in the Authority’s report can be converted into evidence capable of establishing criminal liability wherever it is determined that punishable acts were committed.
