**Man on Bail for Child Sex Abuse Charged with Domestic Violence**
A man who was previously released on bail while facing child sexual abuse charges has been accused of committing multiple domestic violence offenses against his partner. The Nicosia district court's earlier decision to grant him bail under restrictive conditions was overturned by the court of appeal on Friday, following an appeal by Attorney-General George Savvides.
The defendant is now facing a total of eleven charges related to domestic violence, which include violence against women, harassment, and causing actual bodily harm, primarily directed at his partner. Additionally, he has been charged with malicious damage to the home of his partner's mother.
During the initial hearing on September 3, prosecutors argued for the man's detention, citing concerns over a potential flight risk and the likelihood of further offenses. They highlighted the deteriorating health of the complainant, who is reportedly on medication for anxiety, as a significant factor in their request. The prosecution also pointed to the defendant's criminal history, which includes pending charges related to child sexual abuse and the distribution of pornographic material.
Despite these concerns, the district court initially rejected the prosecution's request for detention, referencing sworn statements in which the complainant had withdrawn her allegations. However, the court of appeal found this reasoning insufficient, emphasizing the clear risk of reoffending given that the alleged domestic violence incidents occurred while the man was already under restrictive conditions related to his other legal matters, including the child abuse case.
The court stated that the complainant's withdrawal of her complaint did not impact the assessment of risk, asserting that the prevention of crime should be based on the totality of evidence and the defendant's criminal history rather than solely on the victim's willingness to testify.
With the risk of reoffending established, the court deemed it unnecessary to separately evaluate the flight risk and subsequently remanded the man into custody. He is scheduled to appear again before the Nicosia district court on Monday.
