**Weinstein Sent for Resentencing in Rape Conviction Appeal**
A California appeals court has ordered a new sentencing hearing for former film producer Harvey Weinstein while upholding his convictions for raping and sexually assaulting Russian-born model-actress Evgeniya Chernyshova. The ruling, issued on Friday, determined that Weinstein's original 16-year prison sentence was based on an aggravating factor that is no longer valid.
Weinstein, once a powerful figure in Hollywood, was convicted in 2023 for multiple sexual offenses, including forcible oral copulation, sexual penetration by a foreign object, and forcible rape, all of which occurred during a film festival in Los Angeles in 2013. Following his conviction, he was sentenced to 16 years in prison.
During the sentencing hearing, Weinstein maintained his innocence, characterizing Chernyshova's testimony as fabricated and suggesting that her emotional display in court was disingenuous. The judge in the California case relied on this New York conviction as an aggravating factor when imposing the maximum sentence.
However, New York’s highest court overturned Weinstein's 2020 conviction in 2024. The court found that the inclusion of testimony from women whose allegations were not part of the criminal charges had unfairly influenced the jury's decision. Following this ruling, prosecutors attempted to retry Weinstein, but two subsequent trials resulted in hung juries regarding the charges involving Mann.
In a notable development, New York prosecutors recently announced that they would not pursue a fourth trial against Weinstein after Mann expressed her inability to endure the process of testifying again.
